Article 1 In order to remove mini electric two-wheel vehicles obstructing road traffic and maintain the order and safety of road traffic, Taichung City has enacted d this Self-Government Ordinance.
Article 2 The competent authority of this Self-Government Ordinance is Taichung City Government, with execution authorities and divisions of duties as follows:
1.Police Department of Taichung City Government (hereinafter the “Police Department”): Determination and law enforcement of mini electric two-wheel vehicles subject to removal and custody under each subparagraph of paragraph 1, Article 4.
2.Transportation Bureau of Taichung City Government (hereinafter the “Transportation Bureau”): Administrative work in relation to mini electric two-wheel vehicles subject to removal and custody by the execution authority under the previous subparagraph.
Article 3 A “mini electric two-wheel vehicle” in this Self-Government Ordinance refers to a vehicle governed by Item 3, subparagraph 1, paragraph 1, Article 69 of the Road Traffic Management and Penalty Act of which registration and a license plate are mandatory
in accordance with paragraph 2, Article 69-2 of the same Act.
Article 4 When a mini electric two-wheel vehicle falls under any of the following circumstances and obstructs traffic, execution personnel shall order the driver to relocate the mini electric two-wheel vehicle to a location that does not obstruct traffic:
1.Is parked illegally.
2.Breaks down or is involved in a road-traffic accident and is unable to be moved or driven to another location in a timely manner.
3.Is otherwise subject to relocation and custody in accordance with law or public announcements.
When the driver is not present or fails to move the vehicle to a suitable location in a timely manner, execution personnel may relocate the mini electric two-wheel vehicle and keep it in custody. Stolen vehicles shall however be forwarded to the police authority
for further handling.
Article 5 Before moving any vehicle under the previous article, execution personnel shall issue a warning or other alert. The warning must include language that orders the driver to relocate the mini electric two-wheel vehicle to a suitable location. Execution
personnel shall only move a vehicle if the driver fails to relocate the vehicle to a suitable location after issuing the warning or alert. The content and volume of such warning or alert under the previous paragraph shall be determined by the Transportation
Bureau.
Article 6 When execution personnel move a vehicle under Article 4, photographs shall be taken as evidence of the mini electric two-wheel vehicle's location. Information including the features of the moved mini electric two-wheel vehicle, and the name of
the place of custody and telephone number, etc. shall be provided in colored chalk on the parking spot or other appropriate location before the vehicle is moved to the location of custody designated by the Transportation Bureau. If a vehicle cannot be moved
without damaging the locking device, the locking device may be damaged when moving the vehicle.
The provisions for motorcycles and bicycles under the Taichung City Regulations on the Impoundment of Traffic-Violation Vehicle apply mutatis mutandis to the relocation and custody of vehicles under the first paragraph, and the vehicle owner or an authorized
third party shall be charged a relocation fee and custody fee. Failure to make payment shall be subject to a claim. When a mini electric two-wheel vehicle is relocated and placed in custody under the previous paragraph, notice shall be given to the vehicle
owner to collect the vehicle before a deadline. If the vehicle is not collected before the deadline or if the vehicle owner cannot be identified, the vehicle will be auctioned by the Transportation Bureau after three month of public announcement. The proceeds
from the auction shall be used to cover the relocation fee, custody fee, then other necessary charges in this order. Any remaining balance shall be deposited in accordance with the law.
Article 7 The forms required for this Self-Government Ordinance shall be provided by the Police Department and the Transportation Bureau in accordance with the division of duties.
Article 8 This Self-Government Ordinance is effective from the date of publication. |
