Article 1 To remove abandoned vehicles occupying roadways, reinforce road traffic safety, improve city appearance, and maintain the environment, Taichung City has enacted this Self-Government Ordinance.
Article 2 The competent authority of this Self-Government Ordinance is the Environmental Protection Bureau of Taichung City Government (hereinafter the “Environmental Bureau”) and the assisting authority is the Police Department of Taichung City Government
(hereinafter the “Police Department”).
Article 3 Vehicles referred to in this Self-Government Ordinance include motor vehicles and motorbikes as referenced in the Road Traffic Safety Rules.
Abandoned vehicles referred to in this Self-Government Ordinance include abandoned vehicles as determined in accordance with Article 2 of the Regulations for the Determination Standards and Reporting of Abandoned Vehicles Occupying Roadways.
Article 4 The Environmental Bureau and the Police Department shall proactively respond to reports from the general public of abandoned vehicles occupying roadways.
Article 5 The Environmental Bureau and the Police Department shall send personnel to the location of a reported abandoned vehicle for assessment within 48 hours from receipt of said report.
Article 6 If a vehicle with a license plate is abandoned, a notice shall be affixed in a conspicuous location on the body of the vehicle, photographs taken as proof, and an abandoned vehicle record filled out after the confirmation by the Police Department.
Written notice shall also be issued within seven days to the owner of the vehicle notifying them of the pending removal of the vehicle. If the vehicle is not removed prior to the deadline, the Environmental Bureau will be notified to move the vehicle to a
designated site temporarily.
Article 7 If a vehicle without a license plate is abandoned, a notice shall be affixed in a conspicuous location on the body of the vehicle, photographs taken as proof, and an abandoned vehicle record filled out after the confirmation by the Environmental
Bureau. The deadline for the removal of the vehicle is within 48 hours from the day on which the notice is affixed. If the vehicle is not removed prior to the deadline, the Environmental Bureau shall relocate the vehicle to a designated site temporarily.
Article 8 If the owner or a representative of a vehicle relocated by the Environmental Bureau claims its right and such claim is confirmed, another 48 hours shall be granted to remove the vehicle. If the vehicle is not removed prior to the deadline, the
Environmental Bureau take photographs as proof and relocate the vehicle to a designated site temporarily.
Article 9 If any abandoned vehicle subject to a notice of removal with a deadline by the Police Department or the Environmental Bureau is found to have again occupied the same location or any roadway within a diameter of 50 meters within one month, the vehicle
shall be deemed as not removed. The Environmental Bureau shall take photographs as proof in such instance and relocate the vehicle to a designated site temporarily.
Article 10 After an abandoned vehicle is relocated to a designated site temporarily, the owner or representative of the vehicle shall submit documents proving ownership, the latest tax payment, or revocation of the license plate, and pay the relocation fee
and custody fee before recovering the vehicle.
Article 11 The standards for charging the relocation fee and custody fee shall be governed mutatis mutandis by the Taichung City Self-government Regulations on the Impoundment of Vehicles Involved in Traffic Violations.
Article 12 If an abandoned and relocated vehicle is an advertising vehicle equipped with a billboard, the Environmental Bureau may forward the information of the vehicle owner and vehicle registration details to the relevant authority for verification and
penalty.
Article 13 Personnel handling the relocation, custody, and other relevant tasks of abandoned vehicles shall keep the vehicles intact and shall not dismantle any part of the vehicle.
Article 14 After an abandoned vehicle is relocated to a designated site, the Environmental Bureau shall make a public announcement over the course of one month. If the vehicle is not collected within that period, it shall be scrapped. Any residual value
may be subject to public announcement, tendered sale, and payment to the resource recycling account in accordance with the rules.
Article 15 Tasks involved in the relocation and custody of abandoned vehicles may be outsourced to private institutions.
Article 16 This Self-Government Ordinance is effective from the date of publication. |
